Important: Please read these Terms of Service carefully before using SimpleFeedback. By accessing or using our Service, you agree to be bound by these Terms.
1. Introduction
Welcome to SimpleFeedback! These Terms of Service ("Terms") govern your access to and use of the SimpleFeedback website, applications, and services (collectively, the "Service") operated by SimpleFeedback ("we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.
2. Service Description
SimpleFeedback is a software-as-a-service (SaaS) platform that enables users to:
- Create and customize feedback surveys and questionnaires
- Collect survey responses from respondents
- View analytics and statistics about responses
- Export data in CSV format (Pro tier)
- Share surveys via QR codes and URLs
- Display public results pages (Pro tier)
3. Account Registration and Security
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to maintain and promptly update your account information.
You must be at least 13 years old to use the Service. If you are under 18, you must have parental or guardian consent. We do not knowingly collect data from children under 13.
4. Subscription Tiers
4.1 Free Tier
- Up to 3 active surveys
- Single question per survey
- 500 responses per month across all surveys
- 30-day data retention for responses
- Basic analytics (7-day history)
- QR code generation with branding
4.2 Pro Tier
- Up to 15 active surveys
- Up to 5 questions per survey
- 10,000 responses per month across all surveys
- 90-day data retention for responses
- Advanced analytics (90-day history)
- CSV export functionality
- Public results pages
- Survey pinning (up to 5 surveys)
- Live results polling
- Priority support
5. Payment Terms
Pro tier subscriptions are processed through Stripe, our third-party payment processor. By subscribing, you agree to Stripe's terms of service and privacy policy.
You may cancel your Pro subscription at any time. Cancellation takes effect at the end of the current billing period. You retain Pro access until the period ends.
6. Data Retention Policy
Standard Retention Periods
- Free Tier: Survey responses are retained for 30 days from the date of submission
- Pro Tier: Survey responses are retained for 90 days from the date of submission
After the retention period expires, responses are automatically and permanently deleted from our systems. This deletion is irreversible.
6.1 Extended Retention Buffer
To accommodate billing cycles, technical processing, and account transitions, SimpleFeedback may retain your data for up to:
- 60 days for Free tier accounts (30 days beyond the advertised period)
- 120 days for Pro tier accounts (30 days beyond the advertised period)
This extended retention is provided as a courtesy and does not create any obligation to retain data beyond the standard periods. You should not rely on extended retention for data preservation.
6.2 Downgrade Implications
When downgrading from Pro to Free tier:
- New responses are subject to Free tier 30-day retention immediately upon downgrade
- Existing Pro-tier data may be retained for up to 60 days from the response date
- Data older than 60 days may be deleted at any time after downgrade
- Re-upgrading to Pro within 60 days may restore access to data that would otherwise be deleted
6.3 Data Export Responsibility
You are responsible for exporting important data before:
- Downgrading your subscription tier
- Canceling your account
- Allowing responses to reach their retention limit
SimpleFeedback provides CSV export functionality for Pro tier users. Free tier users should manually record important responses before they expire.
7. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights
- Distribute malware, viruses, or harmful code
- Engage in fraudulent or deceptive practices
- Harass, abuse, or harm others
- Collect data from children under 13 without parental consent
- Send unsolicited communications (spam)
- Attempt to gain unauthorized access to systems
8. Intellectual Property
SimpleFeedback retains all rights to the Service and all related software, trademarks, logos, and branding. You retain all rights to survey content you create and data collected through your surveys.
9. Termination
You may terminate your account at any time. We may suspend or terminate your account for violation of these Terms, non-payment of fees, extended inactivity (12+ months), or legal requirements.
Upon termination, your access to the Service ceases immediately, and your survey data is retained according to our data retention policy.
10. Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY LAW, we are not liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
11. Dispute Resolution
Before filing a claim, you agree to attempt to resolve disputes informally by contacting us at simplerfeedback@gmail.com. Any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. For users in the United States and Canada, any legal action shall be brought in the courts of Delaware or the federal courts of the United States located in Delaware.
13. Third-Party Services
We use third-party services to provide the Service:
- Stripe: Payment processing - subject to Stripe's Terms of Service
- Supabase: Database and authentication - subject to Supabase's Terms of Service
14. Changes to Terms
We may modify these Terms at any time. Changes will be effective immediately upon posting. Material changes will be notified via email to registered users and by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.
